{"id":1622,"date":"2023-11-29T18:27:16","date_gmt":"2023-11-29T17:27:16","guid":{"rendered":"https:\/\/creativecommons.it\/chapterIT\/?p=1622"},"modified":"2023-11-29T18:30:25","modified_gmt":"2023-11-29T17:30:25","slug":"la-corte-dei-conti-torna-a-sostenere-lopen-access-the-italian-court-of-auditors-renews-its-support-for-open-access","status":"publish","type":"post","link":"https:\/\/creativecommons.it\/chapterIT\/index.php\/1622\/","title":{"rendered":"La Corte dei Conti torna a sostenere l&#8217;Open Access\/The Italian Court of Auditors renews its support for Open Access"},"content":{"rendered":"<h2><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-1625\" src=\"https:\/\/creativecommons.it\/chapterIT\/wp-content\/uploads\/2023\/11\/Corte_dei_Conti_-_Sede-300x197.jpg\" alt=\"\" width=\"300\" height=\"197\" srcset=\"https:\/\/creativecommons.it\/chapterIT\/wp-content\/uploads\/2023\/11\/Corte_dei_Conti_-_Sede-300x197.jpg 300w, https:\/\/creativecommons.it\/chapterIT\/wp-content\/uploads\/2023\/11\/Corte_dei_Conti_-_Sede-1024x673.jpg 1024w, https:\/\/creativecommons.it\/chapterIT\/wp-content\/uploads\/2023\/11\/Corte_dei_Conti_-_Sede-150x99.jpg 150w, https:\/\/creativecommons.it\/chapterIT\/wp-content\/uploads\/2023\/11\/Corte_dei_Conti_-_Sede-768x505.jpg 768w, https:\/\/creativecommons.it\/chapterIT\/wp-content\/uploads\/2023\/11\/Corte_dei_Conti_-_Sede-1536x1009.jpg 1536w, https:\/\/creativecommons.it\/chapterIT\/wp-content\/uploads\/2023\/11\/Corte_dei_Conti_-_Sede-2048x1346.jpg 2048w, https:\/\/creativecommons.it\/chapterIT\/wp-content\/uploads\/2023\/11\/Corte_dei_Conti_-_Sede-236x155.jpg 236w, https:\/\/creativecommons.it\/chapterIT\/wp-content\/uploads\/2023\/11\/Corte_dei_Conti_-_Sede-1200x788.jpg 1200w\" sizes=\"auto, (max-width: 300px) 85vw, 300px\" \/><\/h2>\n<h2><b>La Corte dei Conti torna a sostenere l&#8217;Open Access<\/b><\/h2>\n<p><em>di Deborah De Angelis<\/em><\/p>\n<p><span style=\"font-weight: 400;\">Gli esiti dell&#8217;attivit\u00e0 di controllo svolta nel 2022 dalla Corte dei Conti sulla digitalizzazione del patrimonio culturale italiano (di cui si era scritto <\/span><a href=\"https:\/\/medium.com\/@avvdda\/la-corte-dei-conti-sulla-digitalizzazione-del-patrimonio-culturale-italiano-sostiene-lopen-access-c3cfb55d2141\"><span style=\"font-weight: 400;\">qui<\/span><\/a><span style=\"font-weight: 400;\">) sono stati pubblicati, nei giorni scorsi, con la Deliberazione 20 ottobre 2023, n. 76\/2023\/G, in merito alla quale sono stati gi\u00e0 pubblicati diversi articoli a commento.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La Corte dei Conti nel ribadire la centralit\u00e0 dell\u2019adozione di politiche di Open Access nella digitalizzazione e valorizzazione delle immagini del patrimonio culturale italiano in pubblico dominio, non ha potuto non notare come il recente D.M. 161 dell\u201911.4.2023 sulle \u201cLinee guida per la determinazione degli importi minimi dei canoni e dei corrispettivi per la concessione d\u2019uso dei beni in consegna agli istituti e luoghi della cultura statali\u201d si collochi in aperta controtendenza alle istanze gi\u00e0 rassegnate dalla Corte stessa nel suo precedente intervento, incidendo negativamente sulle attivit\u00e0 di studio e di ricerca, sulla valorizzazione del patrimonio culturale italiano, nonch\u00e9 rispetto ad una pi\u00f9 ampia circolazione della conoscenza (sulle criticit\u00e0 del decreto in commento si era gi\u00e0 espressa gran parte della comunit\u00e0 dei professionisti della cultura e, in tal senso, anche il <\/span><a href=\"https:\/\/creativecommons.it\/chapterIT\/index.php\/1529\/\"><span style=\"font-weight: 400;\">Capitolo italiano di Creative Commons<\/span><\/a><span style=\"font-weight: 400;\">).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Come confermato dai giudici contabili, l\u2019Open Access \u201cha da tempo dimostrato di essere un potente moltiplicatore di ricchezza, non solo per le stesse istituzioni culturali (si vedano le ben note best practices nazionali ed internazionali), ma anche in termini di incremento del PIL ed e\u0300 quindi considerato un asset strategico per lo sviluppo sociale, culturale ed economico dei Paesi membri dell\u2019Unione\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nella deliberazione, inoltre, si fa notare come l\u2019introduzione di un siffatto tariffario non tenga conto delle caratteristiche peculiari su cui si basa il funzionamento del web, n\u00e9 tanto meno del potenziale danno alla collettivit\u00e0, ponendosi in contrasto anche con le indicazioni del Piano Nazionale di Digitalizzazione del patrimonio culturale (PND). Prosegue la Corte riconoscendo come la strategia perseguita dal Ministero della Cultura con l\u2019adozione del predetto decreto sia miope per ci\u00f2 che concerne lo sviluppo del potenziale della digitalizzazione in termini scientifici, di conoscenza, ma anche come volano per la crescita culturale e la valorizzazione turistica del territorio.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Alla luce della ribadita posizione della Corte dei Conti a sostegno di politiche di accesso aperto per la diffusione delle immagini dei beni culturali in pubblico dominio, ci si chiede come il Ministero della cultura possa rimanere fermo sulle proprie convinzioni ignorando gli incredibili benefici che l\u2019Open Access pu\u00f2 offrire, come peraltro gi\u00e0 dimostrato dalle istituzioni culturali in tutto il mondo che hanno deciso, con successo, di sposare l\u2019approccio aperto per la condivisione del patrimonio in loro custodia.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Si auspica, pertanto, che il Ministero voglia tornare sui suoi passi recependo anche le istanze provenienti dai professionisti della cultura che pi\u00f9 volte si sono espressi in favore dell\u2019accesso aperto al patrimonio culturale, rendendosi disponibile ad un sereno e propositivo confronto con tutta la comunit\u00e0 di riferimento.<\/span><\/p>\n<p>**********************************************************<\/p>\n<h2><b>The Italian Court of Auditors renews its support for Open Access<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The results of the control activities conducted in 2022 by the Italian Court of Auditors on the digitization of Italy&#8217;s cultural heritage (previously discussed <\/span><a href=\"https:\/\/medium.com\/@avvdda\/la-corte-dei-conti-sulla-digitalizzazione-del-patrimonio-culturale-italiano-sostiene-lopen-access-c3cfb55d2141\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\">) have been released in recent days through Deliberation October 20\u00a0 2023, no. 76\/2023\/G, which has already prompted several commentaries.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While emphasizing the importance of adopting Open Access policies in the digitization and enhancement of images of Italy&#8217;s public domain cultural heritage, the Court of Auditors observes that the recent Ministerial Decree 161 of April 11, 2023, on the &#8220;Guidelines for determining the minimum amounts of fees for the concession of use State-owned cultural heritage,&#8221; goes against the trend the Court of Auditors already stated. It negatively impacts the activities of study and research, as well as the valorization of Italy&#8217;s cultural heritage and broader knowledge circulation. (Many cultural professionals and the <\/span><a href=\"https:\/\/creativecommons.it\/chapterIT\/index.php\/1529\/\"><span style=\"font-weight: 400;\">Italian Chapter of Creative Commons<\/span><\/a><span style=\"font-weight: 400;\"> had already expressed concerns about the decree).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As confirmed by the Court of Auditors, Open Access &#8220;has long proven to be a powerful wealth multiplier, not only for cultural institutions themselves (as evidenced by well-known national and international best practices) but also in terms of increasing Gross Domestic Product (GDP). Therefore, it is considered a strategic asset for the social, cultural, and economic development of European Union member countries.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is pointed out that the introduction of such a fee structure does not take into account the unique characteristics underlying the functioning of the web, nor does it consider the potential harm to the community. This stance is also in contrast with the National Plan for the Digitization of Cultural Heritage (PND). The Court continues by recognizing that the strategy pursued by the Ministry of Culture through the adoption of the decree is short-sighted concerning the development potential of digitization in scientific and knowledge terms, as well as its role as a catalyst for cultural growth and the tourism enhancement of the territory.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In light of the reiterated position of the Court of Auditors in support of Open Access policies for the dissemination of images of public domain cultural heritage, questions arise about how the Ministry of Culture can stand firm on its convictions, ignoring the incredible benefits that Open Access can offer. This is despite the demonstrated success by cultural institutions worldwide that have chosen to embrace an open approach to sharing the heritage in their custody.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is hoped, therefore, that the Ministry will reconsider its position, taking into account the pleas from cultural professionals who have repeatedly advocated for Open Access to cultural heritage.
