Proliferano infatti in tutto il mondo iniziative di istituti culturali volte ad offrire libero accesso alle risorse digitali in rete per superare le distanze fisiche imposte dalle misure di contenimento del contagio.\u00a0<\/span><\/p>\n<p><span>Si tratta di esperienze di cui sar\u00e0 fondamentale fare tesoro anche dopo la fine dell\u2019emergenza, per rilanciare l\u2019imprenditoria culturale, l\u2019industria creativa, il turismo, nonch\u00e9 l\u2019attivit\u00e0 di studio e la ricerca scientifica. La proposta, qui sintetizzata, muove esattamente in questa direzione, al fine di favorire la <\/span><b>libera circolazione delle immagini di beni culturali pubblici non pi\u00f9 protetti dal diritto d\u2019autore<\/b><span>.<\/span><\/p>\n<p><span>Il libero riuso dell\u2019immagine si rivela infatti uno straordinario strumento di innovazione, in quanto favorisce l\u2019editoria culturale (e quindi anche la ricerca scientifica), l\u2019industria creativa e offre nuovi stimoli al settore della moda e del design. Pu\u00f2 inoltre giocare un ruolo importante nell\u2019ambito del restyling grafico degli interni di infrastrutture, mezzi e aree pubbliche migliorando le condizioni di decoro urbano, nonch\u00e9 pu\u00f2 dare impulso all\u2019imprenditoria turistica nelle realt\u00e0 meno visitate e alle pi\u00f9 diverse forme di iniziativa economica. Il libero riuso rappresenta infine un modo per dare attuazione concreta a due principi fondamentali: \u201cil patrimonio \u00e8 di tutti\u201d e \u201cla cultura pu\u00f2 essere un volano per lo sviluppo economico\u201d.<\/span><\/p>\n<p><span>Questi principi hanno ispirato un numero crescente di istituti culturali in tutto il mondo, come la <\/span><i><span>Library of Congress<\/span><\/i><span> o la New <\/span><i><span>York Public Library<\/span><\/i><span>, il <\/span><i><span>Getty Research Institute<\/span><\/i><span>, il <\/span><i><span>Rijksmuseum<\/span><\/i><span>, la Biblioteca Nazionale di Spagna, il Museo Nazionale di Stoccolma e la Galleria Nazionale di Danimarca (che ha adottato lo slogan: <\/span><i><span>It&#8217;s your cultural heritage. Use it!<\/span><\/i><span>), i quali hanno scelto di rendere scaricabili dai propri siti web le immagini ad altissima risoluzione delle opere in pubblico dominio contenute nelle collezioni per incentivare il libero riutilizzo dell\u2019immagine per qualsiasi fine, anche commerciale. Le trasformazioni radicali che il digitale ha prodotto nella nostra societ\u00e0 ci invitano dunque ad abbandonare i tradizionali paradigmi \u201cproprietari\u201d, in favore di una visione del patrimonio culturale pi\u00f9 democratica, inclusiva e orizzontale.\u00a0<\/span><\/p>\n<p><span>In molti casi si riscontra che le entrate provenienti dalla vendita delle immagini o dai canoni applicati sul riuso commerciale delle stesse, siano irrisorie se non addirittura inferiori alle spese di gestione dell\u2019<\/span><i><span>e-commerce <\/span><\/i><span>o del meccanismo concessorio. Per contro, gli istituti che adottano un approccio aperto godono di importanti benefici in termini di marketing, di maggiore afflusso di turisti e, in generale, di maggiore capacit\u00e0 di attrarre finanziamenti pubblici e privati. Infine, la libera circolazione di immagini, anche per scopi commerciali, pu\u00f2 agevolare la creazione di lavoro e redditi in un\u2019economia circolare che, a sua volta, si traduce in maggiori introiti nelle casse dello Stato nell\u2019ambito della fiscalit\u00e0 generale.<\/span><\/p>\n<p><span>Un\u2019occasione importante per agire in questa direzione \u00e8 oggi offerta dall\u2019art. 14 della direttiva 2019\/790\/EU, il quale rimuove i diritti connessi sulle immagini riproducenti opere delle arti visive di pubblico dominio qualora \u201cl\u2019atto risultante dalla riproduzione non costituisca di per s\u00e9 opera originale\u201d.<\/span><\/p>\n<p><span>Un\u2019implementazione di tale disposizione nel senso pi\u00f9 ampio possibile, che tragga cio\u00e8 ispirazione dalle linee guida diffuse da Communia (<\/span><a href=\"https:\/\/www.notion.so\/DSM-Directive-Implementation-Guidelines-45233be9c0e143338860ae5a03118bf3\"><span>https:\/\/www.notion.so\/DSM-Directive-Implementation-Guidelines-45233be9c0e143338860ae5a03118bf3<\/span><\/a><span>), sar\u00e0 determinante per promuovere il libero sviluppo della cultura, della creativit\u00e0, del turismo culturale e, in generale, di tutte le attivit\u00e0 economiche che possono trovare beneficio dalla libera diffusione delle immagini del patrimonio culturale, e per valorizzare lo spirito della normativa europea volta alla creazione di un mercato unico digitale in relazione al diritto d\u2019autore e al pubblico dominio. In particolare la libera circolazione delle immagini di beni culturali in pubblico dominio consentirebbe agli istituti culturali pubblici di perseguire pienamente le proprie finalit\u00e0 istituzionali.<\/span><\/p>\n<p><span>Alla luce di queste premesse e della necessit\u00e0 di rilanciare i settori della ricerca, del turismo e dell\u2019industria creativa piegati oggi dall\u2019emergenza Covid, rivolgiamo questo appello agli Stati membri affinch\u00e9 recepiscano il principio enucleato dall\u2019articolo 14 nel modo pi\u00f9 ampio ed armonizzato possibile, favorendo l\u2019adozione generalizzata da parte degli istituti culturali delle\u00a0 licenze aperte per il libero riuso, per qualsiasi scopo, delle immagini del patrimonio.\u00a0<\/span><\/p>\n<p><span>In particolare, nel caso di riproduzione fedele di opere delle arti visive che sono riconosciute in pubblico dominio in tutto il mondo, incoraggiamo gli istituti culturali ad applicare lo strumento del <\/span><a href=\"https:\/\/creativecommons.org\/publicdomain\/mark\/1.0\/deed.it\"><span>Public Domain Mark<\/span><\/a><span> (PDM) o, in alternativa, <a href=\"https:\/\/creativecommons.org\/publicdomain\/zero\/1.0\/deed.it\">CC0<\/a> se ci sono dubbi sul fatto che la riproduzione sia ancora soggetta a copyright in qualche Stato; mentre, nel caso di riproduzione originale di opere delle arti visive in pubblico dominio, sollecitiamo i predetti istituti, qualora titolari dei diritti d\u2019autore, ad adottare lo strumento <\/span><a href=\"https:\/\/creativecommons.org\/publicdomain\/zero\/1.0\/deed.it\"><span>CC0<\/span><\/a><span>.<\/span><\/p>\n<p><span>Da ultimo, qualora i suddetti istituti non siano i titolari dei diritti sulla riproduzione creativa, riteniamo fondamentale che essi si adoperino, attraverso l\u2019adozione di specifici accordi con i titolari stessi, per il rilascio delle riproduzioni con <\/span><a href=\"https:\/\/creativecommons.org\/publicdomain\/zero\/1.0\/deed.it\"><span>CC0<\/span><\/a><span>.<\/span><\/p>\n<p>**********************************************************<\/p>\n<p><strong>ENGLISH VERSION:<\/strong><\/p>\n<h2 style=\"text-align: left;\"><b>Common appeal to the EU Member States&#8217; competent Ministers and European Cultural Institutions (museums, libraries, archives, galleries, and archaeological sites) for the free reuse of the images of cultural heritage in the public domain<\/b><\/h2>\n<p><span>The Coronavirus emergency has led us to rediscover the centrality of the Internet and the digital space in enhancing knowledge about Cultural Heritage among the public. All over the world, Cultural Institutions are implementing numerous initiatives to offer free access to digital resources on the web, to overcome the physical distance imposed by contagion control measures.\u00a0<\/span><\/p>\n<p><span>These experiences will be even more fundamental after the end of the emergency, to relaunch cultural entrepreneurship, creative industry, tourism, and research activities. The proposal summarized here moves exactly in this direction, by aiming to promote the free diffusion of images of public cultural heritage no longer protected by Copyright Law.<\/span><\/p>\n<p><span>The free re-use of images is an extraordinary lever for innovation, as it favours creative industry and cultural publications (and therefore scientific research), as well as offers new incentives to sectors such as fashion and design. Further, the use of these images can improve urban decorum (supporting the graphic restyling of the interiors of infrastructures, vehicles, and public areas), boost tourism in less visited places, and give impulse to different forms of economic initiative. Moreover, it is a way to enact two fundamental principles: \u201cPublic Heritage belongs to everyone\u201d and \u201cculture can be a driving force for economic development\u201d.<\/span><\/p>\n<p><span>Those principles have inspired an increasing number of Cultural Institutions around the world, such as the Library of Congress, New York Public Library, Getty Research Institute, Rijksmuseum, National Library of Spain, Stockholm\u2019s Nationalmuseum and the National Gallery of Denmark &#8211; SMK (which adopted the slogan: <\/span><i><span>It&#8217;s your cultural heritage. Use it!<\/span><\/i><span>). These institutions decided to make available from their websites high-resolution images of their collections, with the aim of incentivizing the free re-use of those images for any intended purpose, including commercial ones. The radical transformations that digital has produced in our society invite us to abandon traditional &#8220;proprietary&#8221; paradigms, in favor of a more democratic, inclusive, and horizontal vision of Cultural Heritage.<\/span><\/p>\n<p><span>In many cases revenues from the selling of images or fees applied to their commercial use are negligible if not lower than the associated costs. On the other hand, the institutions which adopt an open approach experience gains in terms of increased marketing activities, a higher number of tourists, and, in general, improved attractiveness for public and private funds. Finally, the free sharing of images, including for commercial purposes, may lead to new jobs and incomes in a circular economy, which in turn will generate public revenues.<\/span><\/p>\n<p><span>An important chance to move in this direction is now offered by article 14 of\u00a0 Directive 2019\/790\/EU, which promotes the public domain removing related rights on reproduction of visual artwork into the public domain. The rule states that \u201cwhen the term of protection of a work of visual art has expired, any material resulting from an act of reproduction of that work is not subject to copyright or related rights unless the material resulting from that act of reproduction is original in the sense that it is the author&#8217;s own intellectual creation\u201d.\u00a0\u00a0<\/span><\/p>\n<p><span>An implementation of article 14 as broad as possible, inspired by Communia guidelines (<\/span><a href=\"https:\/\/www.notion.so\/DSM-Directive-Implementation-Guidelines-45233be9c0e143338860ae5a03118bf3\"><span>https:\/\/www.notion.so\/DSM-Directive-Implementation-Guidelines-45233be9c0e143338860ae5a03118bf3<\/span><\/a><span>), is crucial for the development of culture, creativity, tourism, and all other economic activities that benefit from the free spread of Cultural Heritage images, and enhances the spirit of the European law in creating a single digital market for copyright and therefore for the public domain. In particular, the free reuse of images of cultural heritage in the public domain would allow Public Cultural Institutions to achieve their institutional purposes.<\/span><\/p>\n<p><span>For those reasons and for the need to relaunch culture and research activities, tourism and cultural industry affected by the Coronavirus emergency, we appeal the Member States to implement principle stated by article 14 as broadly and harmonized as possible, encouraging the widespread adoption of open licenses for the free re-use, for any purpose, of Cultural Heritage images by Cultural Institutions.<\/span><\/p>\n<p><span>Moreover, we encourage Cultural Institutions to adopt the tool of <\/span><a href=\"https:\/\/creativecommons.org\/publicdomain\/mark\/1.0\/deed.en\"><span>Public Domain Mark <\/span><\/a><span>(PDM) for the faithful reproductions of visual artworks in the public domain worldwide, or <\/span><a href=\"https:\/\/creativecommons.org\/publicdomain\/zero\/1.0\/deed.en\"><span>CC0<\/span><\/a><span> dedication to the public domain, when there are concerns that the reproductions are subject to copyright in some territory and the Cultural Institution was the rights holder.\u00a0<\/span><\/p>\n<p><span>In the case of original reproduction of visual artworks in the public domain, we ask Cultural Institutions to adopt <\/span><a href=\"https:\/\/creativecommons.org\/publicdomain\/zero\/1.0\/deed.en\"><span>CC0<\/span><\/a><span>.
